Introduction and Scope of Services
Dear Guest/s,
We make every effort to provide you with the best services in a pleasant, friendly and homely atmosphere at all times. We strive for your complete satisfaction to provide a safe and secure journey to the best of our ability without any misunderstandings between your good-selves, Enjoy Ethiopia Tours and the tour Leaders. We believe in forgiveness, gratitude, positive attitude and innovation and at times even go beyond legal formats to ensure that all the issues of guest/s are resolved in timely and friendly manner. The Terms and Conditions – hereinafter referred to as Terms and Conditions given here-under and on our website, the tour registration form, any other printed material and Brochures, form the basis of our agreement and understanding with you. Enjoy Ethiopia Tours is a service facilitator and & Guests require to follow policies, rules & regulations, laws & orders of visiting destination and Countries. You are requested to read, understand and sign in acceptance all the Terms and Conditions before you register yourself / family / friends for our tour as a ‘Guest’ to use our services.
Article one:
Short Title, Extent and Commencement:
Terms and Conditions extend to whole of Ethiopia and Africa Tours organized by Enjoy Ethiopia Tours Private Limited – hereinafter referred to as Enjoy Ethiopia Tours .
Terms & Conditions shall come in force from 1st May, 2024 & It will remain in force till further modification or amendment.
Definitions: In these Terms and Conditions unless the context otherwise requires
‘Brochure’ means Leaflets, folder, World Showcase etc brought out / published by Enjoy Ethiopia Tours .
‘Company’ means Enjoy Ethiopia Tours Private Limited.
‘Itinerary’ means a detailed plan for a journey with a list of places to visit; plan of travel, a book describing a route or routes of travel with information helpful to travelers and always subject to Force Major Situations.
‘First day of the tour’ shall start at any time – i.e. in the morning/afternoon/evening at the first destination depending on the mode of transport. The same shall apply in case of the last day of the tour. In other words, a ‘Day’ shall mean a part of the day or 24 hours or its part thereof.
‘Force Majeure’ means an event or circumstance not within the reasonable control, directly or indirectly, of Enjoy Ethiopia Tours in its inability to perform its obligations/responsibilities regarding the tour including (a) war, hostilities invasion, act of foreign enemies; (b) rebellion, revolution, insurrection or military or usurped power or civil war or political turmoil (c) epidemic, pandemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God; (d) ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; (e) riot, commotion or disorder; (f) any act or omission of any Government instrumentality; (g) a Change in Legal Requirements; (h) strikes, lock outs or other industrial disturbances; and (i) abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain and temperatures. (j) unforeseen cancellation by contractors like hotel, transport, suspension of airlines, railways, bus services etc.
‘Group Tours’ mean such tours which are carried out in groups containing various individuals families and where the services provided are similar to all the guest/s in that group.
‘Guest/s’ means the person in whose Name or on whose behalf booking and/or registration is made for any of Ethiopia and/or World Tours organized by Enjoy Ethiopia Tours .
‘Independent Contractor’ means a person and/or organization selected by Enjoy Ethiopia Tours to render services including transport, hotel, air, insurance, restaurant, sightseeing to the guest/s and/or to Enjoy Ethiopia Tours . Independent Contractor is not an employee, partner or joint venture of Enjoy Ethiopia Tours .
‘Meal’ means breakfast, lunch, dinner, packed foods and/or any other snacks (dry/wet) supplied.
‘Tour/s’ means any Africa Tours or Ethiopia tours – also referred as ‘domestic tours’ carried out within Ethiopia and Africa Tours – also referred as ‘International Tours’ carried out in any foreign – Country organized by Enjoy Ethiopia Tours .
‘Tour Leader/Assistant’ by whatever designation called such as Tour manager, Tour escort, Tour Guide etc means a Person designated by Company to guide/assist the guest/s on tour in Ethiopia and/or Africa Tours World Tours.
Orientation Tour: A sightseeing tour is accompanied by a local city guide which points out places of interest. Company may make stops depending upon permission from local authority which may change from season to season.
Article Two
Scope of Activity:
Enjoy Ethiopia Tours is an organization that coordinates all the services of the tour to help the guest/s for undertaking the tour. Enjoy Ethiopia Tours takes utmost care in selecting all the services and/or Independent Contractors who provide their services, to make our guest/s comfortable on tour. Enjoy Ethiopia Tours select various aspects of the tour such as hotel, restaurant, airline, coach, shipping company etc. and does not have any control over operating of the same. Though Enjoy Ethiopia Tours takes utmost care of our guest/s; Enjoy Ethiopia Tours shall not be held responsible for any loss, harm, injury, death, damage caused by default, omission or act of employees or management of any such agencies or Independent Contractors. All the guest/s booking and / or registering for tour organized / proposed to be organized by Enjoy Ethiopia Tours shall read, understand, abide by, strictly comply and observe all the terms and conditions laid down herein or in any / all other publications by Enjoy Ethiopia Tours . We endeavour to update our guest/s from time to time by sending the guest/s various tour related instructions through sms / emails / telephone/ or by any other mode of communication, solely for convenience of the guest/s. Guest/s should check mails regularly for updates sent from Enjoy Ethiopia Tours email id – enjoyethiopiatrips@gmail.com and email from booking person as well as check sms sent by Enjoy Ethiopia Tours on their mobile registered with Enjoy Ethiopia Tours . Guest/s are advised to visit website www.enjoyethiopia.com, www.travelethiopia.com.et and www.visitethiopia.com.et to keep yourself updated with the Terms and Conditions, as Enjoy Ethiopia Tours reserves right to change the Terms and Conditions at any time without prior intimation.
Article Three
Liabilities, Payments, Cancellations and services
NOT INCLUDED IN TRIP COST: Airfare (unless noted otherwise); meals and beverages not stated in trip itineraries; immunizations; passport or visa fees and necessary photos; travel insurance; excess baggage charges; airport taxes, medical, hospitalization or evacuation costs; gratuities to guides and drivers; laundry and other personal items.
EXTRA SERVICES: Though Enjoy Ethiopia Tours is happy to assist with extra services in your tour destination country(s), a surcharge will be levied should the arrangements be made less than one month prior to departure or in country.
Insurance:
Guest/s are advised and recommended to acquire adequate Insurance Policy and Overseas Travel Insurance cover to meet expense of hospitalization, accident etc. during the tour. Enjoy Ethiopia Tours facilitates the travel insurance if requested by the guest and paid by the guest for upto the age of 70 years wherever it is mandatory and guest needs to pay differential insurance charges for age exceeding 70 years over and above the tour tariff. It is obligatory for the guest/s to make full disclosure of medical condition to Insurance Company that may affect his ability to take up and complete the full tour. Insurance Company and /or service provider reserves the right to call for any written certification of guest/s’ medical fitness before departure. Enjoy Ethiopia Tours is insurance facilitator and is not liable/responsible for any reason whatsoever, for settlement of insurance claims and it is a matter solely between the concerned insurance company and the guest/s. Guest/s is/are advised not to carry valuables on tour and keep any valuables in cargo baggage. In case of any unfortunate event while on tour like hospitalization and/or unfortunate demise, it shall be the sole responsibility of the guest/s and/or relative of the hospitalized person/deceased to contact and submit the necessary claim to insurance authorities for further processing of the claim.
Health:
Guest/s hereby acknowledges that all the guest/s who have booked the tour is well aware about the itinerary and are Medically fit to undertake the said tour. The Company reserves the right to ask the guest/s to provide written certification of his medical fitness before departure. The persons who are medically fit to undertake the said tours only shall join the said tour. The persons who are and/or who have suffered from any ailments for which they have taken medical treatment and/or have gone into check up and/or hospitalization shall join the tour at their own risk. It is the responsibility of Guest to provide medical certificate on tour or before joining the tour if required by governing authority of the visiting place at your own cost. In case of any health emergency or health related issues while touring, the guest/s shall solely be responsible for it and to make their own arrangements on the tour for medical assistance & other expenses. Guest/s shall not expect the Tour leader to pay full time attention and/or to provide any medical treatment . The Tour Leader has responsibilities for arrangements of tour related services for the group. Enjoy Ethiopia Tours reserves the right to cancel/restrict/modify/amend the tour of such guest/s without assigning any reasons and no refund is applicable in such case. In case of death of guest/s, all the arrangements and advance payments for transportation of dead body including procuring the death certificate, postmortem, repatriation of dead body with all personal effects/property and insurance claims etc. shall be made by the accompanying guest/s and/or relative of the deceased. Company shall make all endeavor to extend any help but cannot guarantee the same. The entire expenses shall be borne by the accompanying guest/s or their relatives. Enjoy Ethiopia Tours or any tour
PAYMENT: Contracts and agreements will be valid consequent to Enjoy Ethiopia Tours’s confirmation of the booking by e-mail and upon receiving of 35% of advance payment to our bank account or to an assigned partner’s account. 65% of payment shall be done on arrival before the commencement of the tour.
CANCELLATIONS: Any cancellation received in 45 days prior to departure will result in a cancellation fee of 50% of the total tour cost. Cancellations receive 20 days prior to the starting date will have a cancellation fee of 80%. The reason for cancellations can result due to fear of travel from actual or threatened terrorism events, sickness or any other personal causes. All payments will be refunded should Enjoy Ethiopia cancels the trip. Even if advance payment have been received by Enjoy Ethiopia Tours PLC, all the above payment conditions will be in effect after signing of this contractual agreement.
Itinerary Changes:
Force Majeure Situations: In case of force majeure conditions, Enjoy Ethiopia Tours reserves the right to change / modify / vary / alter the tour itinerary / change of date of the tour and/ or tour tariff accordingly. Such changes etc. shall be intimated to guest/s, prior to the departure of the tour or on tour as the case may be. Additional charges, if any, due to such changes etc. over and above the tour tariff have to be paid by the guest/s before or on tour itself as the case may be. No complaints /compensations and/or claiming of refunds beyond the provided refund by Enjoy Ethiopia Tours shall be entertained for limitation and/or non- availability of services beyond the control of Enjoy Ethiopia Tours
RESPONSIBILITY: Enjoy Ethiopia Tours (its owners, outfitters, agents and employees)give notice that they act only as the agent for the owners, contractors, and suppliers providing travel services and accommodations, and assume no responsibility or liability for injury, loss or damage to person or property in connection with any service resulting directly or indirectly from any defect in any vehicle, or through neglect or default of any accompany or person engaged in carrying out the tour or other purpose. In the event it becomes necessary or advisable for the comfort or well-being of the passengers, for any reasons whatsoever, to alter the itinerary or arrangements, such alterations may be made without penalty to the tour operators. Additional expenses, if any, shall be borne by the passengers. Enjoy Ethiopia Tours shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, local laws, terrorists acts, climatic conditions, Acts of God, delays, changes or cancellation of travel due to weather conditions, hotel services, car break downs, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of Enjoy Ethiopia Tours control. Baggage is at owner’s risk at all times. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency. Enjoy Ethiopia Tours will charge an extra payment of the total tour cost divided by the total trip dates for an extension trip during the travel. Visit Ethiopia Tours shall not be responsible for the extra payments which rise while extension is a must because of car break downs, floods and any other travel related problems.
Article Four
Governing Laws
Any liability arising from this contractual agreement shall be governed by the appropriate laws and regulations of Ethiopia.
All claims which may arise from this agreement shall be subjected to the Jurisdiction of Ethiopia wherein the cause of the claim arises.
Termination of this contractual agreement shall be based on the relevant legal provisions enshrined under the civil code of Ethiopia.
I have read and understood all the literature describing the program and am aware that no travel is without risk. In the event of illness or accident, I understand that Enjoy Ethiopia Tours will make every effort to reach the person listed under “emergency contact,” but give my permission for emergency medical treatment as required if such notification is impossible or impractical under the circumstances.
